Terms of Service and Sale

By browsing this site, placing an order or starting a filter subscription, you agree to these terms. If you do not agree, do not use the site or order from it. We may update these terms; the version in effect when you place an order governs that order, and continued use of the site after an update means you accept the updated terms.

You must be at least 18 years old and able to form a binding contract to order from this site. We sell and ship only to addresses in the United States, and you agree not to export the product in violation of United States law.

We work to keep product descriptions, specifications, images and prices accurate and current. Specifications are those published in the instruction manual for model LW-S20-AWGEN. Stated water production is a rated figure measured at 86°F (30°C) and 80% relative humidity; actual production depends on the temperature and humidity of the air where the unit runs.

Errors happen. If a product is listed at an incorrect price or with an incorrect description, we may correct the error and cancel or decline any order placed at the incorrect price, even after the order is confirmed. If your payment has already been captured, we will refund it in full. Prices are in United States dollars and may change at any time before you place an order. Applicable sales tax, when collected, is shown at checkout.

Your order is an offer to buy. A confirmation email acknowledges that we received the order; the contract of sale forms when we ship it. We may refuse or cancel an order for reasons including product unavailability, pricing or description errors, suspected fraud, an address we cannot ship to, or a quantity that exceeds our per-customer limits.

You can cancel an order that has not yet shipped by emailing support@lifewellshop.com with your order number. Once an order has shipped, treat it as a return under the Returns Policy.

Payments on this site are processed by Stripe. By submitting payment details you confirm you are authorized to use the payment method and authorize us, through Stripe, to charge the full order amount including any tax. Filter subscriptions are recurring charges governed by the Subscription Terms. We do not store full payment card numbers.

Different purchases are governed by different terms, so it matters where you buy.

• Purchases on Amazon.com: Amazon is the seller of record. Amazon's conditions of use, privacy notice, shipping terms and returns process govern the transaction, and Amazon handles payment, delivery and returns. These terms do not apply to those orders, though the LifeWell Limited Warranty still covers the product.
• Direct purchases of the LifeWell S20 on this site: LifeWell is the seller. Payment is taken by Stripe and the unit is picked, packed and shipped through Amazon's fulfillment network. Amazon acts only as our fulfillment provider; customer service, returns and warranty support come from LifeWell under these terms.
• Direct purchases of replacement filters on this site, including subscriptions: LifeWell is the seller and ships the order itself. These terms govern the sale in full.

The site, its text, images, logos and software are owned by LifeWell or its licensors and are protected by intellectual property law. You may use the site for personal, non-commercial purposes. You may not copy, scrape at a rate that burdens our servers, resell content, reverse engineer the site, interfere with its operation, or use it to send unlawful, infringing or abusive material.

The LifeWell S20 is covered by the One-Year Limited Warranty, which is the only express warranty we give. To the fullest extent permitted by law, and except as stated in that express warranty, the products and this site are provided "as is" and we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

To the fullest extent permitted by law, LifeWell and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of use, arising out of or relating to the site, the products or these terms, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Some states do not allow the limitation or exclusion of certain damages, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including liability for personal injury caused by our negligence or for fraud.

You agree to indemnify and hold harmless LifeWell and its officers, employees and suppliers from any claim, demand, loss, liability or expense, including reasonable attorneys' fees, arising out of your misuse of the products, your violation of these terms, or your violation of any law or the rights of a third party.

These terms and any dispute arising from them or from a purchase on this site are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Most problems are solved quickly by contacting us, so please email support@lifewellshop.com first and give us 30 days to resolve the issue informally.

If we cannot resolve it, the dispute will be brought exclusively in the state or federal courts located in Delaware, and you and LifeWell consent to the personal jurisdiction of those courts. Either party may still bring an individual claim in small claims court where it qualifies. Claims must be brought within one year after the claim arises, to the extent that limit is permitted by law.

If any provision of these terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the rest remains in full force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies linked above, are the entire agreement between you and LifeWell regarding your use of this site and your direct purchases from it.
